1 Purpose and acceptance of the terms

These General Terms of Use and Rental govern all bookings and services provided by Kayak Belgique for kayak or canoe descents of the Semois.

• Acceptance: Any booking made online, by telephone or on site implies unreserved acceptance of these terms by the customer and the participants.
• Legal capacity: The person making the booking declares that they are of legal age and have the legal capacity to commit all the people registered on the booking.
• Changes to the terms: Kayak Belgique reserves the right to amend these terms at any time. The terms that apply are those in force on the date of booking.

• The presentation and online booking of kayak and canoe rentals on the Semois and the other rivers of the Belgian Ardennes

• Hydrological monitoring of the water level of the Semois, Lesse, Ourthe and Amblève
• Information about camping accommodation at Poupehan

3 Conditions of participation and safety instructions

Kayaking is an outdoor water activity that requires strict compliance with the following instructions:

4 Bookings, prices and payment terms

A booking guarantees the availability of boats and shuttles on the chosen date.

• Prices: Prices are shown in euros (€) including all taxes (VAT). They include the rental of the kayak, the paddle, the life jacket, a waterproof bucket and the shuttle service.
• Payment: Payment is required when booking online or before boarding at our bases. Accepted methods include Bancontact, bank cards and bank transfers.
• Personal booking: every booking is personal and not transferable without prior agreement. It is final only after written confirmation from us (e-mail or SMS). We reserve the right to refuse a booking in case of unavailability or dangerous conditions.
• Platform fees and deposit: for every booking made via our platform, platform fees (commission of 10%) are included in the total price displayed. They cover digital services: payment security, real-time availability management, customer support and technical maintenance. The corresponding amount is collected online at the time of booking (deposit); the balance (gross price of the service) is to be paid directly to the provider on the day of the activity. • Times: Departures and arrivals must respect the time slots set at the time of booking and the regional regulations for the Semois.

5 Protection of the environment and the river

The Semois is a protected natural area in the Walloon Region. Every user undertakes to respect the ecosystem:

• Waste management: Zero litter in the river. All rubbish must be placed in the waterproof buckets and thrown into the containers provided at the finish.
• Landing areas: Land only at authorised and signposted places. Landing on private property or protected islands is strictly forbidden.
• Fauna and flora: Do not disturb aquatic wildlife or nesting birds, and preserve the bank vegetation.

6 Liability and insurance

Once on the water, the activity takes place under the own responsibility of each participant:

Kayak Belgique's commitment: we undertake to provide equipment in good working order and a quality service. In case of cancellation for safety reasons (weather, water level), our liability is limited to refund or postponement. The tourist information on the site (opening hours, partner rates, water levels) is given for guidance only and may change: check it with official sources before travelling. 7 Intellectual property

All the content of the website (texts, photographs, videos, logos, source code, structured data, schemas) is the exclusive property of Kayak-semois Ardenne or is the subject of a usage licence granted to Kayak-semois Ardenne.

• Reproduction prohibited without prior written authorisation, for commercial purposes.
• Inbound links allowed provided the site is not presented within a frame (iframe) and the brand image is not harmed.
• Journalistic and non-commercial use: mention the source www.kayak-belgique.com with a link.

8 Personal data

The processing of personal data collected via this site is governed by our Privacy Policy, compliant with the General Data Protection Regulation (GDPR — EU 2016/679) and the Belgian law of 30 July 2018.

9 Security and protection of transactions

To guarantee the confidentiality of your bookings and payments, we apply security protocols in line with industry standards:

• Secure transactions: all exchanges of information and payments are protected by the standard TLS 1.3 / SSL encryption protocol.
• Stream encryption: your personal data is encrypted during transmission to prevent any interception by third parties.
• Approved payment intermediaries: electronic payments are processed by PCI-DSS certified providers; your banking data never passes through our servers.

Our site contains links to third-party websites (partners, tourist offices, SPW, etc.). Kayak-semois Ardenne is not responsible for the content of these sites and does not necessarily endorse them. These links are provided for information purposes only.

11 Applicable law and disputes

These terms are governed by Belgian law.

• In case of dispute, the customer and Kayak Belgique undertake to seek an amicable solution before any legal action.
• Failing an amicable agreement, any dispute will fall under the exclusive jurisdiction of the courts of the competent judicial district in the Walloon Region.
• Applicable texts include: the Code of Economic Law (CDE), Book VI (market practices); the GDPR (EU Regulation 2016/679); the law of 30 July 2018 on data protection; the law of 11 March 2003 on certain legal aspects of information society services.
• For any consumer dispute, you may also refer to the Consumer Mediation Service (BelMed) or to the European online dispute resolution platform: ec.europa.eu/consumers/odr.
